General Terms and Conditions for Using Food Runners LLC Delivery Service, Website, and Apps (Connecticut Jurisdiction)

These General Terms and Conditions (the "Agreement") govern the use of the delivery service, website, and mobile applications (collectively referred to as the "Service") provided by Food Runners LLC (referred to as "Food Runners," "we," "us," or "our") by customers and merchants in the state of Connecticut. By accessing or using the Service, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not use the Service.

For Customers:

1. Acceptance of Terms

1.1. By using the Food Runners delivery service, website, or apps, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1.2. You must be at least 18 years old to use the Service.

2. Service Description

2.1. Food Runners is a delivery service that facilitates the delivery of food and other goods from participating merchants to customers.

2.2. Food Runners acts as an intermediary between customers and merchants. We coordinate the delivery on behalf of the merchants and provide delivery services to the customers.

2.3. The availability, quality, and accuracy of the goods, menus, and prices are the sole responsibility of the participating merchants. Food Runners does not guarantee the availability or accuracy of any item listed on the menus.

3. Ordering and Delivery

3.1. When placing an order through the Food Runners Service, you agree to provide accurate and complete information, including delivery address and payment details.

3.2. Food Runners reserves the right to refuse or cancel any order for any reason, including but not limited to unavailability of the requested goods, inability to deliver to the provided address, or suspected fraudulent activity.

3.3. Delivery times provided by Food Runners are estimates and may vary based on various factors, including merchant preparation time, traffic conditions, and weather. Food Runners shall not be held liable for any delays in delivery.

4. Payments

4.1. The prices listed on the Food Runners Service are set by the participating merchants and are subject to change without notice.

4.2. You agree to pay the total amount due for your order, including the cost of goods, applicable taxes, and delivery fees, as indicated on the Service.

4.3. Payments can be made using the available payment methods supported by Food Runners.

5. Privacy and Data Protection

5.1. Food Runners respects your privacy and handles your personal information in accordance with its Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

5.2. Any information collected by Food Runners will not be shared with anyone unless notified by the respective party, except as required by law or as necessary for the provision of the Service.

5.3. If you choose to sign up with Apple, you agree that your information will be transferred from Apple Inc. to Food Runners LLC for the purpose of signing up for our service. Similarly, if you sign up with your email, you agree to receive periodic information on discounts or other specials.

5.4. If you sign up with your phone number, you understand and acknowledge that Food Runners is not affiliated with any company such as Facebook, Google, Yahoo, etc. We will never use your location or data or sell your information, including device information, including phones, computers, iOS and Android, and information about the use of device location.

6. Refund Policy

6.1. Refunds for orders placed through the Food Runners Service are determined on an individual basis.

6.2. If you have any concerns or issues with your order, including but not limited to incorrect items, quality issues, or delivery problems, please contact Food Runners customer support at support@food-runners.com for assistance.

7. Dispute Resolution

7.1. Any disputes or claims arising out of or in connection with the Service shall be resolved through good faith negotiations between all parties involved.

7.2. If a resolution cannot be reached through negotiations, the parties agree to submit the dispute to binding arbitration in accordance with the laws of the state of Connecticut.

8. Limitation of Liability: To the maximum extent permitted by applicable law, Food Runners shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of the Service.

9. Order Damages during Transport

9.1. In the event that an order is damaged during transport from the partner restaurant to the customer's location, Food Runners LLC will offer the customer either a replacement order or a refund, but not both.

9.2. The customer must notify Food Runners customer support at support@food-runners.com immediately upon receiving a damaged order and provide photographic evidence of the damage.

9.3. Food Runners LLC reserves the right to request the return of the damaged order to the partner restaurant for verification purposes.

9.4. If the customer requests a replacement order, Food Runners LLC will arrange for a new order to be prepared and delivered to the customer as soon as possible, subject to availability and the partner restaurant's operational hours.

9.5. If the customer requests a refund, Food Runners LLC will process the refund within a reasonable timeframe to the original payment method used for the order.

9.6. The decision to offer a replacement order or a refund for a damaged order will be made at the discretion of Food Runners LLC, taking into consideration the circumstances and available options.

For Merchants:

10. Agreement to Provide Goods and Services

10.1. By partnering with Food Runners, you agree to provide your goods or services for delivery through the Food Runners Service.

10.2. You are responsible for ensuring the accuracy of the goods, menus, prices, and availability information provided to Food Runners.

10.3. Any disputes or issues arising with customers or the delivery service should be addressed through the dispute resolution process outlined in these Terms and Conditions.
